Adopted by the Standing Committee of the 13th People’s CongressofGuangdong Province at its 39th Session on January 16, 2022
第一條 為了保護(hù)外商投資合法權(quán)益,優(yōu)化外商投資環(huán)境,促進(jìn)外商投資,根據(jù)《中華人民共和國(guó)外商投資法》《中華人民共和國(guó)外商投資法實(shí)施條例》等法律、行政法規(guī),結(jié)合本省實(shí)際,制定本條例。Article 1 To protect the legitimate rights and interests of foreigninvestors, optimize the environment of foreign investment, andpromoteforeign investment, the Regulations are formulated in light of actual conditions of Guangdong Province (“the Province”) as per the ForeignInvestment Law of the People’s Republic of China, the Regulationsforthe Implementation of the Foreign Investment Lawof the People’s Republic of China, and pertinent laws and administrative regulations.
第二條 本條例適用于外國(guó)投資者、外商投資企業(yè)在本省行政區(qū)域內(nèi)的投資、收益和其他合法權(quán)益保護(hù)。 Article 2 The Regulations apply to the protection of investments, gains, and other legitimate rights and interests made or ownedbyforeigninvestors and foreign-invested enterprises within the administrativeareas of the Province.
第三條 本省依法促進(jìn)外商投資,保護(hù)外商投資權(quán)益,優(yōu)化外商投資服務(wù),規(guī)范外商投資管理,堅(jiān)持外商投資促進(jìn)、保護(hù)、服務(wù)、管理一體推進(jìn),形成全面開放新格局。
Article 3 The Province shall promote foreign investment according to the law, protect the rights and interests of foreign investors, optimize foreign investment services, regulate foreign investment management, as well as adhere to the integrated advancement of foreign investment promotion, protection, service, and management, forming a new pattern of opening up on all fronts.
第四條 縣級(jí)以上人民政府應(yīng)當(dāng)加強(qiáng)對(duì)外商投資權(quán)益保護(hù)工作的組織領(lǐng)導(dǎo),建立健全外商投資權(quán)益保護(hù)工作機(jī)制,及時(shí)協(xié)調(diào)、解決外商投資權(quán)益保護(hù)工作中的重大問(wèn)題。
Article 4 People’s governments at or above the county level shall strengthen leadership over the activities related to the protection of therights and interests of foreign investors, put in place sound mechanisms for such activities, and coordinate efforts to address major problemsarising from such activities in a timely manner.
縣級(jí)以上人民政府商務(wù)主管部門負(fù)責(zé)外商投資權(quán)益保護(hù)工作,牽頭協(xié)調(diào)外商投資權(quán)益保護(hù)中跨領(lǐng)域、跨部門問(wèn)題。其他有關(guān)部門在各自職責(zé)范圍內(nèi)做好外商投資權(quán)益保護(hù)相關(guān)工作。
The departments of commerce at or above the county level shall takecharge of the activities related to the protection of the rights andinterests of foreign investors, and lead or coordinate the resolutionofthe problems that involve different fields and sectors in suchwork. Other related departments shall conduct the work related to the protection of the rights and interests of foreign investors within their respective scope of duties.
第五條 本省按照國(guó)家規(guī)定對(duì)外商投資實(shí)行準(zhǔn)入前國(guó)民待遇加負(fù)面清單管理制度。在外商投資準(zhǔn)入負(fù)面清單之外的領(lǐng)域,各級(jí)人民政府及其有關(guān)部門不得針對(duì)外商投資設(shè)置準(zhǔn)入限制。
Article 5 The Province shall implement the management systems of pre-establishment national treatment and negative list for foreign investment as per the national provisions. People’s governments at all levels and their related departments may not set conditions that prohibitthe entry of foreign investment into the areas that are not on the negative list.
縣級(jí)以上人民政府及其有關(guān)部門應(yīng)當(dāng)配合國(guó)家做好外商投資安全審查相關(guān)工作。
People’s governments at or above the county level and their related departments shall properly cooperate with the national security reviewof foreign investment.
第六條 各級(jí)人民政府及其有關(guān)部門在政府資金安排、政府投資項(xiàng)目建設(shè)、土地供應(yīng)、稅費(fèi)減免、資質(zhì)許可、標(biāo)準(zhǔn)制定、項(xiàng)目申報(bào)、職稱評(píng)定、人力資源政策等方面,應(yīng)當(dāng)依法平等對(duì)待外商投資企業(yè)和內(nèi)資企業(yè),不得制定或者實(shí)施歧視性政策措施。
Article 6 People’s governments at all levels and their related departments shall equally treat foreign-invested enterprises and domestic-investedenterprises in accordance with the law in terms of activities such as government funding arrangements, government investment projects, land supply, tax relief, qualifications and permits, standards formulation, project application, professional title appraisal, and human resources policies. No discriminatory policies or measures shall be formulatedorimplemented. 外商投資企業(yè)依法和內(nèi)資企業(yè)平等參與政府采購(gòu)、招標(biāo)投標(biāo)、土地出讓、 產(chǎn)權(quán)交易等活動(dòng)。
Foreign-invested enterprises and domestic-invested enterprises shall equally participate in government procurement, tendering andbidding, land transfer, property rights transaction, and other activities in accordance with the law.
第七條 省負(fù)責(zé)知識(shí)產(chǎn)權(quán)保護(hù)的主管部門按職責(zé)建立跨區(qū)域、跨部門知識(shí)產(chǎn)權(quán)快速協(xié)同保護(hù)機(jī)制,健全知識(shí)產(chǎn)權(quán)行政執(zhí)法保護(hù)體系,依法處理侵害外國(guó)投資者、外商投資企業(yè)知識(shí)產(chǎn)權(quán)的行為。
Article 7 The government departments of the Province that supervise the intellectual property rights (IPRs) protection shall, within its scopeofduties, establish a cross-regional, inter-departmental fast responsemechanism to protect IPRs, put in place a complete set of administrativelaw enforcement systems related to IPR protection, andhandleinfringements of IPRs owned by foreign investors and foreign-investedenterprises in accordance with the law.
縣級(jí)以上人民政府市場(chǎng)監(jiān)督管理部門應(yīng)當(dāng)會(huì)同商務(wù)、工業(yè)和信息化等有關(guān)部門加強(qiáng)展會(huì)知識(shí)產(chǎn)權(quán)保護(hù),組織和指導(dǎo)展會(huì)主辦方或者承辦方對(duì)侵害參展的外國(guó)投資者、外商投資企業(yè)合法權(quán)益的行為,做好展前排查、展中快速處置、展后跟蹤處理工作。
Administrations for market regulation at or above the county level shall work with the departments supervising commerce, industryandinformation technology, and other relevant activities to strengthen the protection of IPRs during exhibitions, organize and provide guidance for the pre-exhibition screening, during-exhibition rapid disposal, andpost-exhibition tracking and processing to the exhibition organizers or contractors to handle any infringement on the legitimate rights andinterests of foreign investors and foreign-invested enterprises.
鼓勵(lì)外國(guó)投資者、外商投資企業(yè)依法進(jìn)行專利申請(qǐng)、商標(biāo)注冊(cè)、著作權(quán)登記以及開展知識(shí)產(chǎn)權(quán)交易活動(dòng)。
Foreign investors and foreign-invested enterprises shall be encouraged to carry out such activities as patent application, trademark registration, copyright registration, and IPR transaction in accordance with the law.
第八條 縣級(jí)以上人民政府應(yīng)當(dāng)保障外商投資企業(yè)依法公平利用知識(shí)產(chǎn)權(quán)公共服務(wù)資源,在知識(shí)產(chǎn)權(quán)快速審查、快速確權(quán)和快速維權(quán)方面享受服務(wù)。開展各類獎(jiǎng)項(xiàng)評(píng)審活動(dòng),應(yīng)當(dāng)保障外商投資企業(yè)的發(fā)明和其他科技成果平等參與評(píng)審。
Article 8 People’s governments at or above the county level shall make sure that foreign-invested enterprises can make fair use of public service resources related to IPRs in accordance with the law, and have accesstoservices concerning fast review, ownership confirmation, and protection of IPRs. While selecting various award winners, the rights of foreign-invested enterprises to participate in such selections along with their inventions and other scientific and technological advances on a level playing field shall be safeguarded.
第九條 各級(jí)人民法院對(duì)于外國(guó)投資者、外商投資企業(yè)涉及知識(shí)產(chǎn)權(quán)的證據(jù)保全、行為保全、財(cái)產(chǎn)保全申請(qǐng),應(yīng)當(dāng)依法按期受理、審查、作出裁定;對(duì)于故意侵害知識(shí)產(chǎn)權(quán)的行為,情節(jié)嚴(yán)重的,依法適用懲罰性賠償制度。
Article 9 People’s courts at all levels shall take up, investigate, andruleon the applications for the IPR-related evidence preservation, behavior preservation, and property preservation filed by foreign investors andforeign-invested enterprises in time and according to the law. Punitive damages shall be applied to the intentional infringements of IPRs, if the circumstances are severe, in accordance with the law.
第十條 鼓勵(lì)外國(guó)投資者、外商投資企業(yè)基于自愿原則和商業(yè)規(guī)則,與各類市場(chǎng)主體、科研主體開展技術(shù)合作,依法平等協(xié)商確定合作各方技術(shù)侵權(quán)責(zé)任的承擔(dān)、改進(jìn)技術(shù)的歸屬等技術(shù)合作條件。
Article 10 Pursuant to the principles of voluntariness and fair business, foreign investors and foreign-invested enterprises shall be encouragedtoconduct technical cooperation with various market players and scientific research entities. Such conditions of cooperation as identification of the responsibility for technical infringements andtheattribution of improved technologies shall be decided through equal consultation of different parties to cooperate in accordance with the law.
第十一條 行政機(jī)關(guān)以及法律法規(guī)授權(quán)的具有管理公共事務(wù)職能的組織及其工作人員應(yīng)當(dāng)依法保護(hù)履行職責(zé)過(guò)程中知悉的外國(guó)投資者、外商投資企業(yè)的商業(yè)秘密。
Article 11 The administrative organs, as well as the organizations authorized by laws and regulations with the function to manage publicaffairs and their staff members, shall protect trade secrets of foreign investors and foreign-invested enterprises they become aware of in performing their duties according to the law.
司法機(jī)關(guān)應(yīng)當(dāng)依法加強(qiáng)商業(yè)秘密司法保護(hù),充分維護(hù)權(quán)利人合法權(quán)益。
Judicial organs shall strengthen the judicial protection of trade secrets in accordance with the law, to fully safeguard the legitimate rights andinterests of rights holders.
第十二條 鼓勵(lì)銀行業(yè)金融機(jī)構(gòu)加大金融科技應(yīng)用力度,依法為外商投資企業(yè)提供涉外收支便利化和結(jié)算電子化服務(wù)。
Article 12 Banking financial institutions shall be encouraged to increase the application of financial technology, and provide foreign-invested enterprises with the services related to foreign payment and receipt facilitation and electronic processing of trade settlement accordingtothe law.
本省金融機(jī)構(gòu)根據(jù)國(guó)家跨境融資管理政策,為外商投資企業(yè)開展本外幣跨境融資提供相應(yīng)便利。 Financial institutions of the Province shall facilitate the cross-border financing denominated in domestic and foreign currencies thatforeign-invested enterprises initiate in accordance with the national policies for cross-border financing management.
第十三條 縣級(jí)以上人民政府保障外商投資企業(yè)依法平等參與國(guó)家標(biāo)準(zhǔn)、行業(yè)標(biāo)準(zhǔn)、地方標(biāo)準(zhǔn)和團(tuán)體標(biāo)準(zhǔn)的制定、修訂工作,參加各類專業(yè)標(biāo)準(zhǔn)化技術(shù)委員會(huì)的活動(dòng)。
Article 13 People’s governments at or above the county level shall ensureforeign-invested enterprises can equally participate in the formulation and revision of national standards, industry standards, local standards, and group standards, as well as in various activities of technical committees for standardization, according to the law.
省、地級(jí)以上市人民政府標(biāo)準(zhǔn)化行政主管部門制定、修訂與外商投資企業(yè)生產(chǎn)經(jīng)營(yíng)密切相關(guān)的地方標(biāo)準(zhǔn),應(yīng)當(dāng)充分聽取外商投資企業(yè)的意見(jiàn),并推進(jìn)地方標(biāo)準(zhǔn)制定、修訂全過(guò)程信息公開,為外商投資企業(yè)參與地方標(biāo)準(zhǔn)起草、翻譯以及國(guó)際化合作等提供便利和指導(dǎo)。
Standardization departments at people’s governments of the Provinceand people’s governments at or above the prefecture level shall developand revise the local standards in close relation to production and operation activities of foreign-invested enterprises. In the process, they shall take into full consideration the opinions of foreign-investedenterprises, disclose the information on the whole process offormulating and revising local standards, and provide facilitation and guidance for foreign-invested enterprises to participate in the drafting of, translation of, and international cooperation on local standards.
禁止利用標(biāo)準(zhǔn)實(shí)施妨礙外商投資企業(yè)參與公平競(jìng)爭(zhēng)的行為。
Hindering foreign-invested enterprises fromparticipating in fair competition by taking advantage of standards is prohibited.
第十四條 鼓勵(lì)外商投資企業(yè)制定高于推薦性標(biāo)準(zhǔn)相關(guān)技術(shù)要求和具有國(guó)際先進(jìn)水平的企業(yè)標(biāo)準(zhǔn),引導(dǎo)外商投資企業(yè)將科技創(chuàng)新成果轉(zhuǎn)化為企業(yè)標(biāo)準(zhǔn)。
Article 14 Foreign-invested enterprises shall be encouraged to develop corporate standards higher than the recommendedtechnical requirements and aligned with international levels, and convert scientificand technological innovations into corporate standards.
第十五條 各級(jí)人民政府及有關(guān)部門依法保障外商投資企業(yè)公平參與政府采購(gòu)。采購(gòu)人、采購(gòu)代理機(jī)構(gòu)在政府采購(gòu)信息發(fā)布、供應(yīng)商條件確定和資格審查、評(píng)標(biāo)標(biāo)準(zhǔn)等方面,應(yīng)當(dāng)依法平等對(duì)待外商投資企業(yè)。外商投資企業(yè)符合條件的中國(guó)籍員工可以申請(qǐng)加入政府采購(gòu)評(píng)審專家?guī)臁?/p>
Article 15 People’s governments at all levels and their related departments shall ensure foreign-invested enterprises can equally participate in government procurement in accordance with the law. Purchasers and purchasing agencies shall equally treat foreign-investedenterprises according to the law in terms of releasing government procurement information, determining supplier conditions and review qualifications, and devising bid evaluation criteria. Eligible Chineseemployees in foreign-invested enterprises can apply to join the pool ofgovernment procurement review experts.
第十六條 縣級(jí)以上人民政府科技等有關(guān)部門支持外商投資企業(yè)加強(qiáng)自主研發(fā),建設(shè)高水平研發(fā)機(jī)構(gòu);鼓勵(lì)外商投資企業(yè)與其他企業(yè)、科研機(jī)構(gòu)、高等學(xué)校建立聯(lián)合研發(fā)機(jī)構(gòu),開展研發(fā)合作。
Article 16 Science and technology and other relevant departments at orabove the county level shall support foreign-invested enterprises in intensifying independent research and development (R&D), and establishing high-level R&D institutions. Foreign-invested enterprises shall be encouraged to establish joint R&D institutions and carry outR&D cooperation along with other enterprises, scientific research institutions, and colleges and universities.
外商投資企業(yè)平等參與研發(fā)公共服務(wù)平臺(tái)建設(shè)、政府科技計(jì)劃項(xiàng)目等申報(bào),并享受配套政策扶持。 Foreign-invested enterprises shall equally participate in the R&D of public service platforms and the application for scientific&technological programs of governments, in addition to enjoying supporting policies.
大型科研儀器設(shè)施、重大科技基礎(chǔ)設(shè)施按照國(guó)家規(guī)定面向外國(guó)投資者、外商投資企業(yè)開放共享。
Large research instruments and major scientific and technological infrastructure shall be open to foreign investors and foreign-invested enterprises in accordance with national provisions.
第十七條 省人民政府商務(wù)等有關(guān)部門根據(jù)粵港澳大灣區(qū)發(fā)展戰(zhàn)略,發(fā)揮中國(guó)(廣東)自由貿(mào)易試驗(yàn)區(qū)先行先試作用,探索開展外商投資權(quán)益保護(hù)的試驗(yàn)性政策措施,積累可復(fù)制可推廣經(jīng)驗(yàn)。
Article 17 Commerce and other relevant departments of the provincial people’s government shall leverage the piloting role of the China(Guangdong) Pilot Free Trade Zone by following the Development Strategy for Guangdong-Hong Kong-Macao Greater Bay Area, to explore experimental policy measures for protecting the rights and 10 interests of foreign investors and accumulating replicable andscalableexperience.
經(jīng)認(rèn)定的在粵港澳大灣區(qū)內(nèi)的境外高端人才和緊缺人才按照規(guī)定享受出入境、停居留等優(yōu)惠措施。 High-end, much-needed foreign talents identifiedintheGuangdong-Hong Kong-Macao Greater Bay Area shall be entitled to entry and exit, visit and residency, and other preferential measures as stipulated.
第十八條 外商投資企業(yè)引進(jìn)的外國(guó)高端人才辦理工作許可,按照國(guó)家規(guī)定可以不受年齡、學(xué)歷和工作經(jīng)歷限制。
Article 18 High-end foreign talents introduced by foreign-invested enterprises, while applying for work permits, may be free of restrictionson age, education, and work experience in accordance with national provisions.
外商投資企業(yè)引進(jìn)的外國(guó)專業(yè)人才辦理工作許可,按照國(guó)家規(guī)定可以適當(dāng)放寬年齡、學(xué)歷、工作經(jīng)歷等限制。
Foreign professionals introduced by foreign-invested enterprises, while applying for work permits, shall be subject to moderately relaxed restrictions on age, education, and work experience in accordance with national provisions.
第十九條 行政機(jī)關(guān)以及法律法規(guī)授權(quán)的具有管理公共事務(wù)職能的組織起草涉及外商投資的法規(guī)、規(guī)章、規(guī)范性文件和政策措施,以及開展公平競(jìng)爭(zhēng)審查,應(yīng)當(dāng)聽取外商行業(yè)協(xié)會(huì)商會(huì)、外商投資企業(yè)等利害關(guān)系人的意見(jiàn),或者以向社會(huì)公開的方式征求意見(jiàn)。
Article 19 The administrative organs and the organizations with the functions to manage public affairs which are authorized by laws andregulations, shall take into full account the views of foreign industry 11 associations and chambers of commerce, foreign-invested enterprises, and other stakeholders, or solicit opinions fromthe public, whiledrafting laws, regulations, rules, normative documents and policy measures related to foreign investment, as well as carrying out faircompetition review.
第二十條 縣級(jí)以上人民政府商務(wù)、市場(chǎng)監(jiān)督管理等有關(guān)部門應(yīng)當(dāng)編制和公布外商投資政務(wù)服務(wù)事項(xiàng)目錄以及辦事指南,為外國(guó)投資者和外商投資企業(yè)提供服務(wù)和便利。
Article 20 Commerce, market regulation administration and other government departments at or above the county level shall formulateand publish the catalog of government services related to foreign investment, as well as related guidelines, to provide convenient servicesto foreign investors and foreign-invested enterprises.
辦事指南應(yīng)當(dāng)明確政務(wù)服務(wù)事項(xiàng)辦理?xiàng)l件和流程、所需材料、辦理環(huán)節(jié)和時(shí)限、收費(fèi)標(biāo)準(zhǔn)、聯(lián)系方式、投訴渠道等內(nèi)容。
The guidelines shall clearly define the handling conditions andprocedures of government services and formalities, requiredmaterials, specific steps and time limit, fees and charges, contact information, complaint channels, and other relevant content of government services.
符合申請(qǐng)條件,主要申請(qǐng)材料齊全但次要材料缺失的政務(wù)服務(wù)事項(xiàng),可以容缺受理。
Applications for government services that meet the applicationconditions can be accepted when the primary application materials are complete but the secondary application materials are missing.
第二十一條 各級(jí)人民政府及其有關(guān)部門應(yīng)當(dāng)規(guī)范對(duì)外商投資企業(yè)的行政檢查,科學(xué)合理設(shè)定市場(chǎng)監(jiān)管、勞動(dòng)監(jiān)察、環(huán)境保護(hù)、安全生產(chǎn)、消防安全等執(zhí)法檢查頻次,按照省的規(guī)定推行綜合查一次制度。 Article 21 People’s governments at all levels and their related departments shall regulate administrative inspections offoreign-invested enterprises, by setting the frequency of law enforcement inspections such as market supervision, labor supervision, environmental protection, production safety, and fire safetyinascience-based, reasonable manner, and by carrying out acomprehensive inspection instead of separate ones in accordance with the provisions of the Province.
第二十二條 各級(jí)人民政府及其有關(guān)部門應(yīng)當(dāng)鼓勵(lì)創(chuàng)新,對(duì)涉及新技術(shù)、新產(chǎn)業(yè)、新業(yè)態(tài)、新模式的外商投資實(shí)行包容審慎監(jiān)管,并區(qū)分不同情況制定相應(yīng)的監(jiān)管規(guī)則和標(biāo)準(zhǔn)。
Article 22 People’s governments at all levels and their related departments shall encourage innovation, supervise foreign investments involving new technologies, industries, business forms, operating modes inclusively and prudently, and develop differentiated regulatory rules and standards for varying situations.
第二十三條 縣級(jí)以上人民政府應(yīng)當(dāng)暢通外商投資企業(yè)糾紛解決渠道,建立和完善調(diào)解、仲裁、行政裁決、行政復(fù)議、訴訟等有機(jī)銜接、相互協(xié)調(diào)的多元化糾紛解決機(jī)制,為外商投資企業(yè)提供高效、便捷的糾紛解決途徑。
Article 23 People’s governments at or above the county level shall put in place unimpeded channels to settle disputes related to foreign-investedenterprises, and establish a diversity of closely-integrated, mutually-coordinated dispute settlement mechanisms including mediation, arbitration, administrative adjudication, administrative reconsideration, and litigation, all of which provide foreign-invested enterprises with efficient and convenient approaches to dispute resolution.
第二十四條 外國(guó)投資者、外商投資企業(yè)可以對(duì)本省行政區(qū)域內(nèi)的行政機(jī)關(guān)以及法律法規(guī)授權(quán)的具有管理公共事務(wù)職能的組織及其工作人員侵犯其合法權(quán)益的行政行為進(jìn)行投訴,以及反映投資環(huán)境方面存在的問(wèn)題、提出完善有關(guān)政策措施的建議。
Article 24 Foreign investors and foreign-invested enterprises may file complaints about the administrative behavior in breach of theirlegitimate rights and interests committed by the administrative organs of the Province, as well as the organizations authorized with the functionto manage public affairs and their staff members, according to the pertinent laws and regulations. Meanwhile, they may also point out theproblems existing in the investment environment and recommend policy measures for improvement.
省人民政府商務(wù)主管部門以及地級(jí)以上市、縣級(jí)人民政府指定的部門或者機(jī)構(gòu)(以下統(tǒng)稱投訴工作機(jī)構(gòu))分級(jí)負(fù)責(zé)協(xié)調(diào)、處理相關(guān)投訴事項(xiàng)。其他有關(guān)部門按照職責(zé)分工,配合做好相關(guān)工作。
The department of commerce at the provincial people’s government, as well as the designated departments or agencies by the people’s governments at or above the prefecture level and the countylevel (hereinafter collectively referred to as “the complaint handlingagencies”), shall coordinate the handling of complaints ondifferentlevels. Other relevant departments shall cooperate with the handling process in line with the division of duties.
第二十五條 投訴工作機(jī)構(gòu)應(yīng)當(dāng)做好下列工作:
Article 25 The complaint handling agencies shall performthe following activities:
(一)受理投訴事項(xiàng); (1) Receive and accept complaints;
(二)協(xié)調(diào)處理投訴事項(xiàng),召集相關(guān)部門研究重大投訴事項(xiàng)處理工作;
(2) Coordinate the handling of complaints and convene related departments to handle major complaints;
(三)向本級(jí)人民政府和上一級(jí)主管部門報(bào)告投訴的重大問(wèn)題,通報(bào)有關(guān)單位被投訴和處理投訴的情況,提出意見(jiàn)和建議;
(3) Report major complaints to the people’s government at the same level and the direct supervising authority at a higher-level, informtheunits about which the complaints have been raised of how complaints are handled, and provide feedback and recommendations;
(四)開展投訴情況統(tǒng)計(jì)和分析;
(4) Conduct statistics and analysis of complaints;
(五)其他相關(guān)投訴工作。
(5) Perform other activities related to complaint handling.
外國(guó)投資者、外商投資企業(yè)提出投訴時(shí)要求對(duì)企業(yè)信息、個(gè)人信息予以保密的,投訴工作機(jī)構(gòu)應(yīng)當(dāng)依法保密。
If foreign investors and foreign-invested enterprises, when filing complaints, request that the information of the enterprises and individuals concerned be kept confidential, the complaint handling agencies shall keep it confidential according to the law.
第二十六條 投訴工作機(jī)構(gòu)接到外國(guó)投資者、外商投資企業(yè)投訴后,應(yīng)當(dāng)在五個(gè)工作日內(nèi)決定是否受理,并書面告知投訴人;不予受理的,應(yīng)當(dāng)說(shuō)明理由。
Article 26 After receiving complaints filed by foreign investors andforeign-invested enterprises, the complaint handling agencies shall decide whether to accept the complaint cases for further handling within five working days. If a complaint is accepted for further handling, awritten notice shall be sent to the complainant; if not, reasons shall be explained properly.
投訴工作機(jī)構(gòu)應(yīng)當(dāng)在受理投訴之日起二十個(gè)工作日內(nèi)辦結(jié)受理的投訴事項(xiàng);事項(xiàng)復(fù)雜確需延期的,可以依照國(guó)家規(guī)定適當(dāng)延長(zhǎng)處理期限,并告知投訴人延期理由。
The complaint handling agencies shall settle complaints within twenty working days from the date when the complaints are accepted. For complex cases, an appropriate extension may be granted in accordance with the pertinent national provisions, and the reasons for extension shall be made known to the complainants.
投訴工作機(jī)構(gòu)協(xié)調(diào)投訴事項(xiàng)時(shí),被投訴的行政機(jī)關(guān)以及法律法規(guī)授權(quán)的具有管理公共事務(wù)職能的組織及其工作人員應(yīng)當(dāng)予以配合。
The administrative organs under complaint, as well as the organizations authorized by laws and regulations with the function to manage public affairs and their staff members, shall cooperate with the complaint handling agencies to coordinate the handling of complaints.
第二十七條 各級(jí)人民政府及有關(guān)部門在外商投資權(quán)益保護(hù)工作中不依法履行職責(zé)的,依照法律法規(guī)追究責(zé)任,對(duì)直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員依法給予處分。
Article 27 People’s governments at all levels and their related departments, if failing to fulfill their lawful duties in the protection of foreign investors’ rights and interests, shall be held accountable in accordance with the applicable laws and regulations. The directly responsible persons-in-charge and other directly responsible personnel shall be punished according to law.
第二十八條 本條例自 2022 年 3 月 1 日起施行。
Article 28 The Regulations shall come into force on March 1, 2022. 16
